What is a work permit?
A work permit (Work Permit) is a legal document issued by the competent authorities in Vietnam to foreign workers. It is a mandatory condition for foreigners to work legally in Vietnam, except in some cases where they are exempt from the permit according to regulations.
A work permit plays a crucial role in managing foreign labor, ensuring the rights of both workers and businesses employing foreign labor, and supporting the control of immigration and illegal labor.
Benefits of having a legal work permit
For foreign workers:
Work legally in Vietnam without legal concerns.
Enjoy benefits under the labor contract, such as social insurance and health insurance.
Easily apply for a long-term temporary residence card, saving costs compared to continuous visa extensions.
Opportunity for permanent residency in Vietnam if meeting the conditions.
For businesses employing foreign workers:
Avoid legal risks and penalties for using illegal labor.
Ensure compliance with Vietnam’s foreign labor management regulations.
Build a reputable and legally compliant working environment that is professional and transparent.
According to Decree 152/2020/ND-CP, foreign workers working in Vietnam without a work permit may face the following penalties:
Foreign workers: They may be deported from Vietnam.
Businesses employing illegal labor: They may be fined from 60 million VND to 400 million VND, depending on the number of violating workers.
Therefore, obtaining a work permit is a mandatory condition, not only to comply with the law but also to avoid unnecessary legal consequences.
