A work permit service for foreigners in Vietnam is essential as the country continues to attract more foreign experts and skilled workers. However, the process of preparing documents and completing administrative procedures can be complex and time-consuming.

A work permit is a legal document issued by a competent Vietnamese authority that allows foreign nationals to work legally in Vietnam. It is a mandatory requirement for most foreign employees, except for certain cases that are exempted under Vietnamese law.

In addition, foreign employees who hold valid work permits can apply for long-term Temporary Residence Cards, which significantly reduces the need for frequent visa extensions and the associated costs. In certain cases, having a work permit may also support long-term residence in Vietnam if all legal conditions are met.
For businesses employing foreign workers, obtaining work permits helps avoid legal risks and administrative penalties related to illegal employment. It also ensures that the company complies with Vietnam’s regulations on the management of foreign labor. Furthermore, a properly regulated employment process contributes to building a transparent and professional working environment, enhancing the credibility and stability of the business.
According to the provisions of Decree No. 152/2020/ND-CP, foreign nationals who work in Vietnam without a valid work permit may face serious administrative penalties.
Foreign workers who violate these regulations may be deported from Vietnam. Employers who hire foreign workers without proper authorization may be subject to administrative fines ranging from VND 60 million to VND 400 million, depending on the number of foreign employees involved in the violation.
For this reason, applying for a work permit is not only a legal obligation but also an essential step to avoid unnecessary legal consequences for both employers and foreign employees.
According to the latest regulations under Decree 152/2020/ND-CP, foreign nationals must satisfy several conditions in order to obtain a work permit in Vietnam.
Foreign employees must have full civil act capacity as required under Vietnamese law. They must also be in good health and able to perform the job, which must be confirmed by a valid medical certificate issued by an authorized health institution. The applicant must not have a criminal record and must not be subject to any restriction on entry into Vietnam. In addition, the employee must possess appropriate professional qualifications or specialized skills that are relevant to the position offered by the employer. Before submitting the work permit application, the employer must also obtain approval from the Department of Labor, Invalids and Social Affairs regarding the demand for hiring foreign workers.
Employers who wish to hire foreign workers must demonstrate the necessity of employing foreign labor, meaning that the position cannot be filled by Vietnamese employees. The company is also required to complete the procedure for approval of foreign labor demand before officially recruiting the foreign employee.
For the foreign employee, several documents must be prepared as part of the application. A notarized copy of a valid passport is required. The employee must provide two passport-sized photographs taken within the last six months with a white background. A criminal record issued within the previous six months must also be submitted. In addition, the applicant must present a valid health certificate issued by a qualified medical institution. Documents proving educational qualifications and professional expertise relevant to the job position are also required. The applicant must also provide confirmation of at least three years of relevant work experience from a foreign employer. Finally, a labor contract or recruitment decision issued by the Vietnamese company must be included.
The sponsoring company must provide a notarized copy of its business registration certificate or investment registration certificate. In addition, the company must submit the official approval document from the Department of Labor, Invalids and Social Affairs confirming the approval for recruiting foreign workers.
All documents issued overseas must be consular legalized and notarized translated into Vietnamese before being submitted to the competent authority.
The process begins with an initial consultation during which the eligibility of the foreign employee is reviewed. At this stage, the business is guided on how to prepare the necessary documents in accordance with the most recent legal regulations.
After that, foreign documents are translated into Vietnamese and notarized. If the documents were issued overseas, assistance is provided for the consular legalization process at the relevant embassy or consulate.
The next step involves submitting an application to the Department of Labor, Invalids and Social Affairs to obtain approval for the company’s demand to employ foreign workers. This procedure typically takes from ten to fifteen working days.
Once the approval document has been issued, the work permit application is submitted to the competent authority. The processing time for issuing the work permit usually takes between five and seven working days.
After the work permit is issued, it is delivered to the client. Additional assistance may also be provided for related procedures if necessary.
