– Within 15 days prior to the expected date of employing the foreign worker, the employer must submit the work permit application dossier to the Ministry of Labor, Invalids and Social Affairs.
– The maximum validity period of a work permit is 2 years.
– Upon expiration, the foreign worker may apply to extend the work permit once, with a maximum extension period of 2 years.
– Cases where a work permit is still valid but no longer effective include:
+ Termination of the labor contract;
+ Revocation of the work permit;
+ Discrepancy between the content of the labor contract and the work permit;
+ The foreign worker’s actual work does not match the content stated in the work permit;
+ Termination or expiration of the contract or agreement that served as the basis for issuing the work permit;
+ Written notice from the foreign party to cease dispatching foreign workers to Vietnam;
+ Cessation of operations by the Vietnamese enterprise, partner, organization, or foreign organization in Vietnam employing the foreign worker.

Cases Where Foreign Workers Are Eligible for a Work Permit Under Regulations

The subjects eligible for a new work permit are stipulated in Decree No. 152/2020/ND-CP. These are foreign nationals entering Vietnam for the following purposes:

  • Performing a labor contract;
  • Intra-company transfer;
  • Executing economic, commercial, financial, banking, insurance, scientific-technical, cultural, sports, education, vocational training, or medical contracts or agreements;
  • Providing services under contract;
  • Negotiating service provision;
  • Working for foreign non-governmental organizations or international organizations permitted to operate in Vietnam under Vietnamese law;
  • Serving as managers, executive directors, experts, or technical workers;
  • Participating in the implementation of packages or projects in Vietnam.

Responsible Party for Paying Work Permit Issuance Fees for Foreign Workers

Pursuant to Article 11 of Decree 152/2020/ND-CP and Decision 526/QĐ-LĐTBXH, the responsibility for carrying out the procedures and paying the work permit issuance fees for foreign workers lies with the employer. Therefore, the employer is required to cover the costs of obtaining the work permit.

The dossier for applying for a work permit includes:

– Written request for issuance of a work permit by the employer;
– Health certificate or medical examination certificate issued by competent medical authorities in the foreign country or in Vietnam, valid within 12 months;
– Judicial record certificate or document confirming that the foreign worker is not currently serving a sentence, has not had a criminal record expunged, or is not under criminal prosecution, issued by a foreign country or Vietnam, not older than 06 months from the issuance date to the dossier submission date;
– Documents proving the status of manager, executive director, expert, technical worker, or other positions as prescribed by law;
– 02 color photos (size 4cm x 6cm, white background, full face, bare head, no colored glasses), taken within the last 06 months from the dossier submission date;
– Document approving the demand to use foreign workers, except for exempted cases;
– Certified copy of a valid passport as prescribed by law;
– Other relevant documents concerning the foreign worker as required.

Note: The above documents must be originals or certified copies. If issued abroad, they must be consular legalized (except where exempted under international treaties to which Vietnam and the relevant country are parties, or under the principle of reciprocity, or as prescribed by law), translated into Vietnamese, and notarized/certified as required by Vietnamese law.
