Căn cứ tại Khoản 11 Điều 3 Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam 2014 được sửa đổi bổ sung năm 2019 quy định:

A visa, also known as an entry visa or thị thực, is a document issued by the competent authority of Vietnam, permitting a foreigner to enter Vietnam.

Accordingly, foreigners wishing to enter Vietnam must possess a visa and other required documents as prescribed, except in cases eligible for visa exemption under the regulations.

The validity periods of work visas are stipulated as follows:
– The maximum validity of a work visa shall not exceed 3 months in cases of short-term entry for work without a work permit.
– The maximum validity is up to 1 year (12 months) in cases where the foreigner has been issued a work permit, is exempt from a work permit, or is an investor.

Types of Work and Labor Visas for Foreigners in Vietnam

Theo khoản 16 Điều 8 Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam 2014 được sửa đổi bởi điểm e, điểm g khoản 3 Điều 1 Luật sửa đổi 2019, work visas are those bearing the symbols LD1 and LD2.

Foreigners working in Vietnam are granted two types of work visas: short-term work visas and long-term work visas.

– Short-term visas have a maximum validity of 3 months and are issued to foreign experts, managers, and skilled workers entering Vietnam to work with enterprises or organizations in Vietnam under visa symbols DN1 or DN2.
– Long-term work visas for foreigners working in Vietnam have a maximum validity of 1 year (12 months) and apply to foreigners holding a work permit or a certificate of exemption from work permit requirements, with visa symbols LD1 or LD2.

Visa LD1 is a visa with a maximum validity of 1 year (12 months) issued to foreigners working in Vietnam who have confirmation that they are not subject to work permit requirements.

Visa LD2 is a visa with a maximum validity of 1 year (12 months) issued to foreigners working in Vietnam who hold a work permit.

Note: In cases where the work permit has a validity period of less than 1 year, the visa validity for the foreigner shall be equivalent to the validity period of the work permit.

Conditions and Required Documents for Applying for a Work Visa for Foreigners in Vietnam

Work Visa Services for Foreigners in Ho Chi Minh City

Pursuant to Article 10 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 as supplemented by Clause 5, Article 1 of the Law (Amended) 2019, the detailed conditions for visa issuance are as follows:

– Possession of a passport or other international travel document of equivalent value.
– Sponsorship or invitation by an agency, organization, or individual in Vietnam, except as provided in Clause 3, Article 17 of this Law.
– Not falling under any cases ineligible for entry as stipulated in Article 21 of this Law.
– Foreigners entering for employment purposes must hold a work permit in accordance with the provisions of the Labor Code.

Required documents for visa application:

Theo khoản 2 Điều 16 Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam 2014, the documents to be submitted in the notification to the Immigration Department include:

– Written notification of sponsorship for visa issuance to enter Vietnam;
– Certified true copy of the enterprise registration certificate;
– Document introducing the seal and signature of the authorized person of the organization.

Theo Điều 12, Điều 17 Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam 2014 được bổ sung bởi khoản 7 Điều 1 Luật sửa đổi 2019 và Thông tư 04/2015/TT-BCA, the dossier for requesting visa issuance for foreign workers to be submitted to the Immigration Department includes the following documents:

– Application form for Vietnam visa issuance;
– Certified true copy of the work permit or certificate confirming exemption from work permit requirements already issued;
– Supporting documents if falling under one of the following visa-exempt categories:
+ Pursuant to international treaties to which Vietnam is a party.
+ Holders of permanent residence cards or temporary residence cards in accordance with Vietnamese law.
+ Entry into border-gate economic zones or special administrative-economic units.
+ Pursuant to unilateral visa exemption decisions by Vietnam.
+ Overseas Vietnamese holding passports or international travel documents issued by competent foreign authorities, and their foreign spouses or children; foreign spouses or children of Vietnamese citizens eligible for visa exemption as prescribed by the Government.
+ Entry into coastal economic zones as decided by the Government, provided the following conditions are met: possession of an international airport; separate space; clearly defined geographical boundaries separated from the mainland; compliance with socio-economic development policies; and no detriment to national defense, security, social order, or safety of Vietnam.

– Immigration Department or Provincial/City Police Immigration Division at the location of the enterprise’s or organization’s head office.
– In addition, enterprises or organizations may submit dossiers online via the National Public Service Portal and the Ministry of Public Security Public Service Portal, in accordance with prescribed procedures.

Procedures for Applying for a Work Visa for Foreigners in Vietnam

Step 1: Prior to carrying out procedures to invite or sponsor a foreigner to enter Vietnam, the sponsoring or inviting agency, organization, or individual must submit a written notification along with the dossier to the Immigration Department.

Such notification shall be made only once; any changes to the dossier contents must be supplemented.

Step 2: The inviting or sponsoring agency, organization, or individual directly submits the written request for visa issuance to the Immigration Department.

– Inviting or sponsoring agencies or organizations may opt to submit the visa issuance request and receive responses electronically via the electronic immigration portal if they meet the legal requirements.

Step 3: Within 05 working days from the date of receipt of the visa issuance request, the Immigration Department shall review, process, respond to the inviting or sponsoring agency, organization, or individual, and notify the competent Vietnamese authority abroad authorized to issue visas.

Step 4: Upon receipt of the response from the Immigration Department, the inviting or sponsoring agency, organization, or individual shall inform the foreigner to proceed with visa receipt procedures at the competent Vietnamese authority abroad.

Fees and Processing Time for Issuing Work Visas for Foreigners in Vietnam

– Fees for issuing work visas bearing symbol LD1 for foreigners:

Multiple-entry visa valid for 3-6 months 95 USD per visa
Multiple-entry visa valid for 6-12 months 135 USD per visa

– Processing time: Not exceeding 05 working days from the date of receipt of a complete dossier.
